By using WApp Chat, you agree to be bound by these Terms. If you do not agree, you must not use the platform.

1. Overview of Our Services #

WApp Chat is a SaaS platform that enables users to:

  • Generate WhatsApp click-to-chat links
  • Add pre-filled custom messages to those links
  • Generate downloadable QR codes for sharing
  • Track link analytics (clicks, location, usage)
  • Create multi-agent routing links
  • Build multilink landing pages
  • Generate branded short links (e.g., wapp.chat/yourbrand)
  • Link to WhatsApp product catalogs and forms
  • Import opted-in contacts and manage WhatsApp automation workflows
  • Send WhatsApp-approved template messages and campaign notifications where available
  • Access dashboard with real-time stats and advanced filters
  • Share links through social media, websites, or offline (QR)

Some features are free, while others require a paid plan.

2. User Responsibilities #

By using WApp Chat, you agree that you will:

  • Provide accurate and updated contact information
  • Use your own valid WhatsApp number for link generation
  • Not impersonate others or create fake business identities
  • Keep your login credentials secure and not share your account
  • Ensure the links you create do not mislead, spam, or cause harm
  • Not upload malicious scripts or violate other users' security
  • Respect platform bandwidth limits and usage fairness policies
  • Obtain, store, and honor valid consent before sending WhatsApp messages to any recipient
  • Use WhatsApp templates, automation, and campaign tools only in compliance with Meta, WhatsApp, and applicable messaging laws
  • Immediately honor opt-out, unsubscribe, STOP, block, or similar requests
  • Report bugs, abuse, or policy violations if discovered

You are responsible for all activity under your account, including all data generated and shared using your dashboard.

3. Allowed Use Cases #

WApp Chat is built to support:

  • Small businesses, freelancers, and creators who want to communicate via WhatsApp
  • Agencies that manage links for multiple clients
  • Online sellers, educators, event organizers, etc.
  • Businesses using WhatsApp as a support, sales, or appointment platform
  • Businesses sending transactional, support, utility, or marketing messages to recipients who have given valid consent
  • Integrations with CRMs, Google Sheets, n8n, forms, booking tools, property systems, and similar platforms where the customer has lawful permission to process and message the contact

If you use WApp Chat to import contacts, create campaigns, send WhatsApp template messages, connect automation APIs, or trigger messages from external systems, you are solely responsible for ensuring that each recipient has given valid permission to receive messages from your business.

You agree that:

  • You will only import, upload, or message contacts where you have a lawful basis and required opt-in consent.
  • You will keep accurate records of consent, including the opt-in source, time, business name, and consent language where applicable.
  • You will not mark contacts as opted in unless they actually gave permission to receive WhatsApp messages from your business.
  • You will not send or attempt to send unsolicited bulk messages, scraped-contact campaigns, purchased-list campaigns, spam, phishing, or deceptive content.
  • You will use WhatsApp-approved templates only for the message categories and purposes for which they were approved.
  • You will comply with WhatsApp Business Platform rules, Meta policies, anti-spam laws, privacy laws, consumer protection rules, and any industry-specific rules that apply to your messages.
  • You will provide and honor a clear opt-out mechanism where required, including requests sent by WhatsApp reply or through another support channel.

WApp Chat may provide technical tools such as opt-in fields, template selection, import confirmations, rate limits, logs, and abuse controls. These tools do not replace your legal obligation to collect valid consent and comply with third-party platform rules.

Prohibited Use Cases:

  • Phishing or scam campaigns
  • Spamming WhatsApp users or mass unsolicited outreach
  • Uploading or messaging contacts without valid opt-in permission
  • Falsely claiming opt-in, forging consent records, or using misleading opt-in language
  • Promoting illegal, harmful, or adult content
  • Selling fake products or impersonating brands
  • Misusing QR codes for malicious redirects or unauthorized promotions
  • Using bots to mass-generate links or abuse analytics and tracking features
  • Circumventing account limits, subscription rules, or fair usage systems

If you are found violating these rules, your account may be suspended or terminated without notice, and your data may be removed.

4. Account Suspension and Termination #

We reserve the right to:

  • Suspend or delete accounts that violate our terms or local/international laws
  • Disable or redirect links that are flagged for abuse, phishing, malware, or copyright infringement
  • Ban IPs, email addresses, or phone numbers involved in repeated violations
  • Remove any content or links generated that harm the reputation or functionality of WApp Chat
  • Revoke Pro access for fraudulent payments, suspicious activity, or payment disputes
  • Pause campaigns, block message sending, disable automation keys, or require proof of opt-in where we detect abuse risk, high failure rates, recipient complaints, policy violations, or suspicious sending patterns

We are not responsible for loss of traffic, leads, or business if your account is suspended for violating these terms.

5. WApp Chat's Rights and Disclaimers #

We retain the right to:

  • Modify, add, or remove features at any time for stability, legal, or product improvement reasons
  • Restrict access to certain high-risk features (e.g., public multilinks, redirect URLs) at our discretion
  • Change pricing, plan structures, or offer promotions with or without prior notice

Legal Disclaimers:

  • WApp Chat is not affiliated with WhatsApp Inc. or Meta Platforms in any way
  • We do not claim ownership of WhatsApp trademarks or visual identity
  • We do not control Meta, WhatsApp, carrier, recipient-device, or third-party platform decisions, including template approval, message delivery, quality ratings, account limits, or account suspension
  • We do not guarantee that use of WApp Chat will prevent your WhatsApp Business Account, phone number, templates, or Meta assets from being restricted, reviewed, suspended, or disabled
  • We do not guarantee that generated links or QR codes will work forever; they may expire if abused or unused
  • All analytics and click reports are for informational use only and are not certified metrics

WApp Chat is provided on an "as-is" and "as-available" basis. Use of our service is at your own risk.

6. Payment and Subscription Terms #

  • Paid features are part of our monthly or annual subscription plans.
  • Payment is processed securely through third-party payment gateways (e.g., Stripe, Razorpay).
  • We do not store your card or banking details on our servers.
  • You may cancel your subscription at any time, but no refunds will be issued for partial billing cycles.
  • Failed or expired payments may lead to restricted access or automatic downgrading to the Free plan.
  • WApp Chat may offer trials, discounts, or credits at its sole discretion.

7. Intellectual Property #

  • All logos, designs, code, branding, database schema, and platform structure belong to WApp Chat.
  • You may not copy, replicate, clone, or reverse-engineer any part of the service.
  • You may export your data while your account is active but cannot reuse platform functions elsewhere.
  • User-generated links and QR codes are stored for usage during account activity only.

8. Limitation of Liability #

WApp Chat shall not be liable for:

  • Direct or indirect loss of sales, leads, or opportunities due to broken or disabled links
  • WhatsApp suspending your number based on external reports
  • Meta, WhatsApp, or another third party rejecting, delaying, limiting, or blocking your messages, templates, numbers, business account, or integrations
  • Claims arising from your contact imports, opt-in records, campaign content, automation triggers, or failure to honor opt-out requests
  • Hosting downtime or service outage caused by third-party infrastructure
  • Misuse of public links by people outside your organization

Maximum liability under any claim will not exceed the total amount paid by the user in the last 3 months.

9. Indemnification #

You agree to indemnify and hold WApp Chat, its developers, partners, and service providers harmless from any claims, liabilities, damages, costs, and expenses (including legal fees) arising out of:

  • Your misuse of the platform
  • Violation of these Terms
  • Any content or links created using your account
  • Your contact lists, campaigns, templates, automation events, opt-in records, opt-out handling, or use of WhatsApp/Meta services
  • Any allegation that your messages were unsolicited, unlawful, deceptive, non-compliant, or sent without valid consent

10. Governing Law #

These Terms shall be governed by the laws of India. Any legal dispute shall be subject to the jurisdiction of the courts located in [Insert City/State], India. If any provision of these Terms is found to be invalid under applicable law, the rest shall remain in full effect.
